A Fy-law to amend the "Lend Use Contract No. 18 Authorization Ry-law,
1976, No. 1462" and to authorize the making of an amendment to Land ‘se Contracs
ho. 18.

WHEREAS The Corporation of the City of Port Coquitlam, pursuant to
the provieions of the “Land Use Contract No. 18 Authorization By-law, 1976, No.
1462" has entered into a Land Use Contract with Kinsway Development Led. respecting
oroperty now described as Lot 314 and 315, District Loc 466, Group One, Plan
51224, New Sestriuster District; .

ANL WHEREAS it is thougltdesirable to make an amendment to the said
Land Use Contract;

NO@ THEREFORE, the Municipal Council of The Corporation of the City
of Post Coguitlan, in open meeting assembled, enacts as follows:

The Council! of The Corporation of che City of Port Coquitlam is
hereby autherized and empowered to enter into an amendnene to Land Use Contract
No. 18 in the form and ce che extent set forth in "Land Use Contract No. 18 -
4cendsent Document” which is a Schedule hereto annexed and made part of this
BFy-lav.

2. The saiz Lace Use Contract No. 18 = Amendment Document shall extend
to and shall regulate the development and use of the lands described therein.

3. Lend Use Contract Xo. 18 ~ Azenduent Document shall have che force
and effect of a Restrictive Covenant running ith the land described therein and
shall be registeres én the New Westaiaster Land Registry Office.

4, This By-law may be cited fer all purposes as the "Land Use Contract
No. 13 - Acencnent Bocument Authorization By-law, 1978, No. 1595",

OF THE THIRD PART:

NOTWITUSTAMDING any of the provisions of Land Use Contract No. 18 which
said Land Use Contract forms the Schedule to the “Land Use Contract No. 18
Authorization By-law, 1976, No. 1462" of The Corporation of the City of
Port Coquitlam it 1s understood and agreed between the Parties hereto chat:
1. The Parcel "E" (now known as Lot 315, District Lot 466, Group One, Plan
51224, New Westminster District) shown on ‘Appendix I to Lane Use Contract No.
18, shall be used only for parking for the McDonald's Restaurant located on
Parceis "A", "B", "cl" and "“p" (now known as Lot 314, District Lot 466, Group
One, Plan 51224, New Westminster Districe).

2. The siting details for Parcels "a", “BY, “Cc, ", and "E” shall be as

shown on Appendix I of this document and not ag on Appendix II of Land Use

Contract No. 18.
