That Rezoning Application No. 74/92 and OCP Amendment No.75/92 for 1884 Argue Street be approved in principle to proceed for Rezoning from C-1 (Comer Store) to RM-3 (Townhouse - Apartment) under Section 963 of the Municipal Act and for amendment of the Official Community Plan designation from "Highway Commercial" to “Apartment” subject to: a. Submission of a design to the satisfaction of the Director of Planning, that fully complies with the provisions of the RM-3 zone, the "Development Management Bylaw" (Parking Bylaw), and the guidelines for development of this area contained in the Riverfront Area Control Plan; Satisfaction of Engineering requirements, Satisfaction of Fire Department concerns; Submission of landscaping plans to the satisfaction of the Parks and Recreation Department, Satisfaction of Building Department concerns; The area identified in the drawing No.1 attached to Council Agenda to be designated a Development Permit Area; and Issuance of a Development Permit. Provision of permanent consent to allow the City the leasing of a public right-of-way of sufficient width along the edge of vegetation to permit construction of a boardwalk. The exact location and width of the right of way to be determined prior to final reading, with assistance from the Ministry of Environment. The City will agree not to build the boardwalk until it has obtained sufficient rights to have a continuous boardwalk from the Pitt River Road end to a location near the eastern end of Argue Street as sketch attached to Council Agenda denotes.
