Municipal Engineer, may be varied because of conditions at the site so
that the works function and operate in a manner satisfactory to the

Municipal Enginer; and should the vorks provided to be constructed

herein prove to be in any way defective or should they not operate to
the satisfaction of the Municipal Engineer prior to completion, then
the Developer shall, at his own expense, modify and reconstruct the
said works to that the said works shall be fully operati72 end
function to the satisfection of the Municipal Engineer.

Cost_of Development:

21. The entire cost of the development including the provision -
ef all services and the provision and construction of the works
described herein shall be paid by the Developer.

Representations and Warranties, etc.:

22. It is understood and agreed that the Municipality has made
no representations, covenants, warranties, guarantees, promises or

agreements (verbal or otherwise) with the Developer other than those
in this Contract. .

Tegistration:

23. This Contract shall have the force and effect of a
restrictive covenant running with the land and shall be registered
in the Land Registry Office by the Municipality, pursuant to the
provisinus of Section 702A(4) of the "Municipal Act".
Inzerpretarion:

24. Wherever the singular or masculine is used herein, the

same shall be construed as weaning the plural, feminine or body

corporate or politic where the Contract or the parties so require.
