aetord with the plans annexed hereto which said plans form part
of thts Schedule.

Subject to the provisions of this Land Use Contract and to

the "Strata Titles Act" of the Province of 8ritieh Columbi2, the

development, use and subdivision of the land and the buildings

thereon as 4 strata subdivision pursuant co the provisions of
the said “Strata Titles Act" may be permictrd.

Except as otherwise provided in this Land Use Contract the
above-nsted use shall be permitted to the linit and extent provided
in Part V of rhe “City of Pore Coquitlam Zoning By-law, 1969, No.
915" as in force on the date of registration of this Agreement in
the New Westninster Land Registry Office as if the said use was
occurring on property zoned. RM-3 {Incermediate Density Apartment
Residential) under. che said Zoning By-law. A copy of the said
Part ¥ is annexed hereta and forms part of this Schedule.

It is understood and agreed between the Developer and the
Municipalicw that construction of 32 of the townhouse strata

title units may commence immediately upon Tegistration of this

Land Use Contrace in the New Westminster Land Registry Office

that construction of the next 32 units shall not commence

until a period of 8 months has elapsed from date of issuance

of che building permit for the first 32 cnits.

It is understood and agreed between the Developer and the
Municipality thae conveyance of the aforesaid Lot 99 to The Corporation of
the City of Port Coquitlam relieves the Developer from Payment of the £455.89
Inspection Fee provided for each self-contained housing unit in clause fa) of
Appendix “A" of the "City of Porr Coquitlam building and Plunbing Code
Administration By-law, 1974, No. 1298". .

Subdivision Plan - Strata Titles Act:

The land herein, together with the buildings and structures thereon,
may be subdivided inte strata lots pursuant to the provisions of the "Strata
Titles Act" and the said subdivision shall be subject to the foli ing linita-
tions:

Parcels to be Created: “STXTY-FOUR (64) Strata Lots
together with common Property. The said
Strata Lots shall be composed of townhouse
building units as detailed in the plans
annexed to Schedule "B" of this Land Use
Contract and the said parcels may be created
by way of phased strata plans pursuant to
Part Il of the Strata Titles Act.
