Cowan presided over the trial, Crown counsel Vern Frolic submitted to the jury that James Lincoln lied to the police concerning his whereabouts the day of the offence. The offence was alleged to have taken place during the early morning hours of Wednesday, Sept. 26 1984 near the south side of Keith Road close to Mills Memorial Hospital. Frolic brought forth evidence that proved both the accused James Lincoln and the complainant were drinking at the Terrace Hotel bar and then at a near- by apartment, prior to the alleged attack, The victim told the jury how the rapist had offered to find her shoes after the alleged rape and to give her $10 for cab fare, said defense lawyer Darrell O’Byrne. The police talked with the accused Lincoln, within an hour of the alleged rape, but did not apprehend him until four days later. The victim picked Lincoln’s photograph out of a lineup on the same day of the of- fence, Sept. 26, 1984. In a statement to the police shortly after his arrest, Lincoln denied any involve- ment in the crime. Defence counsel Darrell O’Bryne and Terence Wright led evidence to show that on Feb. 1985 ina conversation the victim told another person that she wasn’t sure whether or not it was James Lincoln who had raped her because she was too intoxicated.
