In Option 3. Quanta Enterpnises. at their cost. would extend the fll 5 m horizontally out onto the right-of-way, thus shifting the toe of proposed dyke 5 m horizontally away trom the rear of the townhouses. Any additional fill for the dvke, should it be constructed, would be at Program expense Quanta Enterprises are willing to construct the dyke for the Program, either at cost or at a contract price. In addition, if the dyke is constructed. a fence should be erected to delineate the dyke and to ensure that the crest is unobstructed. The cost of this fence, if required, would be shared 50/50 between the Program and Quanta Enterprises. If possible, the Program wishes to delay a decision on whether or not to proceed with Option 3 until negotiations with the Native landowner are concluded. Should a decision be required before these negotiations conclude, the Program may proceed with a scaled-down version of Option 3, shown as Stage 1 on the attached drawing. This would permit full implementation by placing State 2 fill at a later date. The overall proposal has benefit to the Program. Firstly, it keeps open our option of returning to the original dyke alignment. Because of the problems with the Native landowner, this is becoming more of a possibility. Raising the entire site of the townhouse development from 3.5 to 5 m provides a mass fill at elevation 5 m against which to abut a dyke. If the dyke is constructed adjacent to this fill, it will only have to be 0.85 m in height, and because of the limited height the side slopes can be steepened to 2:1. The net effect is that the toe of the fill is kept further away from the sewer line than with the origina! plan. Based on the above understanding, we indicated that the Program had no objection to the 1 m roof overhang of the rear units adjacent to the dyke right- of-way and that we advised the City of this position in the minutes of the meeting dated April 14, 1993.
