Eng., City Engineer SUBJECT: Restrictive Covenant for 2563 Colonial Drive (Public Works Committee Meeting March 17, 1989) RECOMMENDATIONS : l. That the City Engineer be authorized to approve the attached restrictive covenant intended for registration against the property with the civic address of 2563 Colonial Drive. 2. That the Builder, W.E. Industries Ltd., be required to pay the legal costs incurred by the City in this matter. BACKGROUND AND COMMENTS: The Building Department has recently advised that the builder, W.E. Industries Ltd., is constructing a house at 2563 Colonial Drive. During their inspections, the Building Department discovered that the foundations to the house nad been constructed too low to permit gravity drainage of the perimeter drains into the municipal storm sewers. In order to drain this property, the builder has to install a sump pump. This matter was then referred to the Engineering Department for comments and appropriate action. In order to protect the City from future liability claims, the City Engineer recommends that an Indemnification Restrictive Covenant be registered against the property through the Land Titles Office. The builder has agreed to this proposal. The cost of drafting the attached Covenant decument by the City’s solicitor, Mr. Anderson, is estimated to be $150. The Committee recommends that Council accept this Covenant and that the builder be required to pay the City's leqal costs in this matter. =Paat a i T.M. Chong;-P.
