All other words and expressicns in this Agreement, unless the context otherwise requires, shall have the meaning assigned to’ them by the "City of Pore Coquitlam Zoning Bylaw, 1969, No. 918", as amended or, {f not defined therain, by the “Muacipal Act" or the "Interpretation Act" of the Province of British Colucbia,. 2. ‘The. Developer ts the registered ower of an estate in fee sinuple of ALL AND SINGULAR that certain parcel or tract of land and premises situate, lying and being in the City of Port Coquitlam, in the Province of Britisi: Columbia, and being more particularly known and described as; North 128° Lot 12, Block 4, District Lot 379, Group One, Plan. 1213, New Westminster District (hereinafter called “the land"), 3. The Developer has obtained the consent of all persons holding any vegistered interest in the land as set cut in the Consents to the use and development set forth herein, which Consents ate attached hereto, 4. (a) The land, including the surface of water, and any and all ‘tulldings, structures and improvements erected thereon, there- over or therein shall be used for the undernoted purposes only and for n» other purposes whatsoever: Comercial Apartment Residential Accessory Advertising Actessory Off-Street Parking fccesscry Off-Streec Loading Family Day Care Group Dey Care . Out of School Day Care Pre School Child Minding Except as otherwise provided in this Land Use Contract the above-ncted uses shall be permitted to the limit and extent provided in Part VI of the "City of Port Coquitlam Zoning By~ law, 1969, No. 918" as in force on the date of registration of tis Agreement in the New Westminster Lead Registry Office as if the said use was occurring on propetcy zoned C-4 (Town Sub-Centre Commercial), under the said Zoning By-law. A copy of the said vart VI is attached hereto as Appendix 1, Zoning By-law. A copy of the said Part VI £s attached hereto as Appendix 1, 5. (a) No building, structure or improvement shall be sited upon the land except in compliance with the site plan and particulars set ove in Appendix II herein which contains: (1) Drawing No. Al entitled Floor Plans - Scheme Two = Front and Rear Elevations; and (14) Drawing No. A2 entitled Foundation Plan - Scheme Two ~ Ele sttans and Sections Prepared by B.G. Marr & Associates, Architects, labelled "Proposed Commercial and Apartment Building on Marpole Street, Port Coquitlam, 8.C. fer Mr. Bill Rusin" and bearing Job No. 7416. (b) All construction details shall conform to the provisions of the applicable portions of the National Building Code of Canada, the British Columbia Plumbing Code, and the "City of Port Coquitlam Building aud Plumbing Code Administration By-law, 1974, No. 1298", 6. Notwithstending the provisions of the "City of Port Coquitlam Subdivision of Land By-law, 1970, No. 992" the land shall not be subdivided in any nanner whatsoever except as permitted by the Strata Titles Act, 7. No sign or signs shall be erected upon the land or on any building or structure thereon except as permitted by the "City of Port Coquitlan Zoning By-law, 1969, No. 918", as amended, and in accordance with the provisions of the "City of Port Coquitian Sign By-law, 1969, No. 936" as amended, and all previsions therein relating to signs in the C-4 (Town Sub-Centre Commercial) Zone shall apply to signs herein. 8. Off-street parking, loading spaces, playground areas, playground equipment, garbage pick-up areas, and other facilities and amenities shall be provided, located and. constructed in accordance vith Appendix IT hereto, 9. All buildings and structures shall be constructed strictly in compliance with and according to the plans, elevations and perspective set out in Appendix it hereto, provided however that mincr alterations fo the plans may be permitred and approved by the Building Inspector. 30. All landscaping,: surface treatments, fences and screens shall be - constructed, located, provided and maintained in compliance with and according to tha plans set out in Appendix II hereto.
