V3C 2V1 (the "Owners") THE CORPORATION OF THE CITY OF PORT COQUITLAM 2272 McAllister Avenue Port Coquitlam, B.c. V3C 2A8 (the "City") WHEREAS: A. The Owners are the owners in fee simple of that certain parcel of land situated at 1361 Una Way in the City of Port Coquitlam and legally described as: Parcel Identifier No. 006-929-061 Lot 880, District Lot 341, Group 1, Plan 33834, New Westminster District (the "Land"). The City has constructed and maintained over Many years a public parking area on that portion of the Land shown cutlined heavily in blue (the "Parking Area") on the Statutory Right of Way plan referred to in this Agreement. The public has used the Parking Area for parking and the Owners and the City agree that it should continue to be used for parking, subject to the terms and conditions of this Agreement. dD. This Agreement is necessary for the Operation and Maintenance of the City's undertaking. NOW THEREFORE the Owners and the City in consideration of the sum of $10.00 paid by the City to the Owners, the receipt and sufficiency of which is acknowledged by the Owners, and for other valuable consideration, agree as follows: 1. The Owners grant in perpetuity to the City, subject to the terms of this Agreement, a right of way at all times for the City, its officers, employees, agents, contractors, and invitees; and the public at large, to enter, pass over, and use the area shown outlined in black on the Statutory Right 37
