Alderman Thompson inquired whether there is a connection between the use of the building and the contract granted and the City Administrator advised that the Land Use Contract specifies that one of the uses is a library, but the only connection if Council is wishing to negotiate further on use of the space, probably completion of the Land Use Contract may be another indication that the Council is working towards the conclusion of a lease. Mr. Horner suggested that the reference in the Land Use Contract is that of a public facility (library), and he pointed out that he was requested to proceed with the project under a Land Use Contract because there is no zoning in the City which would permit a library to be located over retail operations. Alderman Thompson inquired of Mr. Horner whether he felt that passage of the Land Use Contract committed the Council to an agreement to occupy the premises and Mr. Horner advised that it did not. Alderman Keryluk pointed out that at a meeting with Mr. Horner when the engineering problem was encountered, he had been advised to go ahead with the design of the facility at 150 pounds per square foot, and on that basis Mr. Horner has discussed the working drawings with the Building Inspector; however, Alderman Mabbett commented that in July of last year he did not visualize there would be a tight year ahead of the City financially. Alderman Laking advised that Alderman Traboulay, who was not in attendance this evening, had contacted him and stated he had had second thoughts about the situation, and he suggested that it be tabled for discussion by the Council as a wholes; however, Alderman Keryluk pointed out that at no time in 1976 has a member of Council approached him with any concern about the project. Alderman Thompson stated that on his clear understanding that the Land Use Contract does not commit the City to leasing space for the proposed library facility from Mr. Horner, he was prepared to approve final passage of the Zoning Amendment By-law and signing of the Land Use Contract, and he then proposed the following motions: Moved by Alderman Thompson: Seconded by Alderman Ranger: That By-law No. 1398 be reconsidered, finally passed and adopted.
