September 14, 1994 TYPE 2 Farm Market Farm or Estate Winery Nursery The storage, sale and processing, of agricultural products grown on or off the farm are currently a ‘special case’ or conditional us¢ in the ALR. Such uses require an application to the Commission for permission, pursuant to Section 44 of BC Regs 313/78, This type of application is made directiy to the ALC. TYPE 3 Farm Retail Market Fruit/Produce Store The sale of agricultural and non-agricultural products on Jand in the ALR is considered a not-farm use and requires an application to the Commission pursuant to Section 20(1) of the ALC Act, In summary, Type | retail sales are an outright use in the ALR, Type 2 retail sales are a conditional use in the ALR and require direct application to the ALC; and Type 3 retail sales are a non-farm use in the ALR and require application (via local government) to the Cominission. This draft policy proposes to exempt Type 2 Farm Markets, Farm and Estate Wineries and Nurseries from the application procedure through the specific definition of these uses, where such uses arc considered acees"“ry to the main farm use of the property. The Commission proposes to establish 2 threskold level of retail activity, below which applications to the ALC would not de required. This policy will be iniplemented by a General Order of the ALC. Type 3 retai} sales which include both agricultural and non-agricultural products that may or may not be produced on the farm will continue to require application to the ALC. In the development of the draft policy for retail sales of agricultural products in the ALR, the Commission considered two categories of regulatory elements: 1. Land Use Building Size Outdoor Display Area Parking Minimum Lot Size Site Coverage 2. Product Product Type 4.2 Product Origin Product Volume ($) Following initial discussion it was decided to simplify the policy by defining a standard size and level of retail activity with the following parameters: lL. Retail Sales Area (combined building size and outdoor display area) a Product Type (agricultural or non-agricultural) 3. Product Origin (on-farm or off-farm) As indicated the policy proposes to exempt a specified size and type of farm market, nursery and farm and estate winery from the ALR application procedure. .
