forever discharges the City from and against all manner of
actions, causes of action, claims, debts, suits, demands and
promises whatsoever at law Or in equity whether known or unknown
which Canfor or any other person now has or may at any time have
against the City by reason of the Works. causing any delay in the
construction, maintenance and repair to the Lands and any of the
public works or utilities located. thereon or by reason of the
Works causing any delay or prevention of the City's right of
uninterrupted passage on the travelled portion of the Lands.

Te a This: Agreement shall not. in any Way restrict the right
of the City at any time to widen, raise or lower the dyke, road
or. ancilliary works. within the Statutory Right: of Way ‘on,
abutting or adjoining the Lands and Canfor INDEMNIFIES the City
‘for any additional costs of construction, maintenance: and
inspection which the City may ‘incur as a result of the Works and
impeding access to the Lands and’ in. the event that the City does
alter the width. or elevation or both of the said dyke, road or
ancilliary works, Canfor hereby releases and forever discharges
the City from all Manner of claims of any Nature whatsoever which
Canfor or any other person. now has or May at any time have
against the City by reason of such alteration of width or
elevation or both or by reason of the Works causing any delay in
the alteration in width or elevation or both: _

8. Wherever the Singular or masculine is used in this
Agreement, the Same shall be deemed to include the plural or the
feminine or the body politic or corporate as the context so
requires; every reference to each party hereto shall be deemed to
include the heirs, executors, administrators, Successors,
assigns, employees, agents, officers and invitees of such party
wherever the context so requires; time is of the essence herein;
the covenants contained herein run with the lands; and this
Agreement shall enure to the benefit of and be binding upon the
