Re: 1973 Municipal Act Amendments ~ Election Procedures

We wish to draw to the Council's attention the following amendments to the

Municipal Act with respect to Municipal Elections.

New Sections 53A and 53B have been enacted to provide for the election of the

Council on a bi-annual basis and/or on a ward basis. The exact wording of these two
sections is as follows: .
Election 53A. (1) Notwithstanding any other provision of this Act or of the
of Aldermen. Letters Patent or supplementary Letters Patent of a municipality, the Council
may, by by-law, provide that all Aldermen shall be elected biannually.
(2) The by-law under subszction (1) shall make provision for the transition
from an annual election to a biznnual election of Aldermen.

Election 53B. Notwithstanding any other provision of this Act or of the Letters

members Patent or supplementary Letters Patent of a municipality, the Council may,
by by-law, with the approval of the Lieutenant-Governor in Council, provide
that all or some members of the Council shall be elected on an area or ward
basis and in the by-law shall define the areas or wards and make provision for
the orderly transition to the ward or area basis.

If the Council wish to issue any instructions with respect to the preparaticn of

the by-laws mentioned in the new ‘Municipal Act sections it would now be an appropriate

time so to do,

Additionally, the Municipal Act has been amended so as to require the election of

directors to the Regional Board and Section 57A is set out hereunder for the Council's
information:

Reston S7A. (1) The municipal Director or Directors of the Regional Board,
Director, herein called a “Regional Board Director,’ shall be nominated and elected in
accordance with this section from among the candidates nominated for
Mayor and Alderman.
(2) The notice of poll pursuant to subsection (2) of section 65 shall
indicate whether the candidate nominated for Mayor or Aderman is also a
candidste for the ertice of Regional Board Director,
(3) A separate balutepeper shall be prepared containing the names of th
candidates for Mayor and Atdernian who are cand:dates for the office of
Regional Board Director.
