One of the ierms contained in that Water Licence, as was originally granted by an act of the Legislature of British Columbia, was to restrict any hydro- electricity created to be exclusively used in the vicinity of the works, The Attorney General’s staff's current inter- pretation or opinion is that Alcan’s licence al- - lows them to produce power for B.C. Hydro to buy for export. , Given that the wording of the original li- cence specifically intended that the power generated would be used by Alcan to smelt aluminum, creating jobs, this new opinion sug- gests that either the legislature has amended the original Water Licence without legislation, or that Alcan is dictating to the legislature. This interpretalion seems more to cxcuse the provincial government from its culpability by participating in an action that is contrary to provincial legislation rather than hold Alcan responsible to the terms under which its Water Licence was granted. This new opinion is also the reverse to that presented during the Nechako Commission hearings. At that time, the Water Licence and the conditions under which it was granted were deemed violated if Alcan sold power at the expense of local jabs. These hearings were terminated premature- ty when Mike Harcourt’s administration made a deal with Alcan and dissolved the mandate of the inquiry. If Alcan is not going to exclusively use the power generated in area works, then the li- cence should be considered cancelled. B.C. Hydro should also be notified as to the illegal- ity of its actions. While £ am not recommending that the le- gislature cancel Alcan’s water licence out- right, I do expect that they will finally begin to hold Alcan and B.C. Hydro to the full and complete conditions of the legislation under which said licence was granted.
