BSR res tena TEN RPP Pa SHIN MAIN AGREEMENT Page 10 September 26, 1988 ARTICLE 3 - PARKS 3.1 The Developer covenants and agrees to sell to the City and the City covenants and agrees to purchase from the Developer the two park areas shown in SCHEDULES MA-LL and MA-L2, for convenience only referred to as Skyline Park and Future Park respectively, and shown as Lots 1 and 113 respectively on Schedule MA~-C on the following texms and conditions. The Developer agrees to construct and pay for the improvements ag shown on Schedule MA-LIA Schedule A and Schedule MA~L2A Schedule A ard shown on Schedules MA~L1 and MA-L2 to the reasonable satisfaction of the City and to provide and pay for inspection services during the construction and maintenance of the improvements up to the transfer of the Parks to the City, by the Landscape Architects responsible for the design. The City agrees upon substantial completion of the work for each park as certified by the Landscape Architect and the City, to review the improvements for that Park or Parks for conformity to the requirements outlined in the relevant SCHEDULES MA-~ Ll and MA-L2 and provide a final deficiency list to the Developer. . The City agrees that one year after the substantial completion, as certified by the respective Landscape Architects and the City, during which year the Developer shall at its cost maintain the Parks, to the City's satisfaction the Developer may then submit a demand to the City in accordance with the terms of the Option to purchase and this agreement that the City within 30 days pay to the Developer the sums outlined below and do all these things necessary to transfer the title for the Park to the City. The Park works outlined in SCHEDULE MA-L1 are to be completed in conjunction with Phase 1 as shown on SCHEDULE MA-D and SCHEDULE MA-LI1A to SCHEDULE MA~L1 and the Park works outlined in SCHEDULE MA-L2 are to be completed in conjunction with Phase 2 as shown on SCHEDULE MA-D and SCHEDULE MA~L2A to SCHEDULE MA-L2.
