THE CORPORATION OF THE CITY OF PORT COQUITLAM - BY-LAW NO. 1509 A By-law to assess, levy and collect the cost of the work of local improvement authorized by By-law No. 1448 of The Corporation of che City of Pore Coquitlam. WHEREAS pursuant to By-law No, 1448 of The Corporation of the City of Port Coquitlam, being the "Fraser Avenue Storm Sewer Local Improvement Construction By-law, 1976, No. 1448" reconsidered, finally passed and adopted on the Fourteenth day of June, 1976, a Storm Sewer of a "Local Street" cons.cuction standard on an Advanced Construction Schedule; was constructed on Fraser Avenue from the East boundary of Wellington Street te the West boundary of Vincent Street in the City of Port Coquitlam as a work of local improvement under the provisions of Part XVI of the “Municipal Act", as amended. AND_WHEREAS the estimared lifetine of the work i3 Twenty (20) years; AND WHEREAS the Treasurer has certified the total cost of the work to be Ten Thousand Eight Hundred Thirty Dollars and Eighty-seven Cents ($10,830.87), of which Four Hundred Seventy-seven Dollars and Thirty-six Cents ($437.36) ts the City's portion of the cost, and Ten Thousand Three Hundred Fifty-three Dollars and Fifty-one Cents ($10,353.51) is the owmers' portion of the cost calculated at the rate of $9.00 per foot of taxable foot frontage as Provided in the "Local Improvement Charge By-law, 1969, No, 912", as amended; AND WHEREAS the City's portion of the cost of the work has been paid from the general revenue of the City our of moneys appropriated therefor in the annual budget; AND_WREREAS the owners" portion of the cost has been paid from the Local Inprovenent Fund; AND_WHEREAS the actual foot-frontage of the parcels of land benefiting fron or abutting the work is 1,162.09 feet and the taxable foot-frontage of the parcels of land benefiting from or abutting the work is 1,150.39 feet; AND WHEREAS it is necessary to impose a frontage-tax upon the parcels benefiting from or abutting the work in order to vecover to the Local Improvement Fund the owners" portion of the cost, plus interest; ZEREFORE the Municipal Council of The Corporation of the City of Port Coquitlam, in open meeting assembled, enacts as follows: 1. A frontage tax shall be and is hereby imposed and levied upon the parcels of land set forth in Column I o! Schedule "A" of this By-lav, which said Schedule is attached hereto and forms a part hereof, -2- 2. The frontage tax shall be levied eack year for a peried of ten (16) years, as provided by the “Local Improvement Charge By-law, 1969, Xo. 912", as amended, comnencing in the year 1977 and shall be collected annually by the Collector of the City at the same time and in the same manner as other annual tates and taxes, and shall be subject to the same penalties for non-paynent and the amount thereof, except as otherwise Provided, will be the product of the taxable foot-frontage and the amiwal rate. 3. The annual rate ghall be $1.50 per front foor of taxable foot~frontage as provided by the “Local Improvement Charge By-law, 1969, No. 912", as anended. The frontage tax imposed herein shall, save as directed by the Ceurt of Revision, he imposed on the respective parcels in the manner set forth in Column IT of Schedule "A" Opposite the description of the parcel in Coluzs I. 5. The frontage tax collected as aforesaid shall be paid into the Local Improvement Fund of the City. 6 The provisions of the "Local Improvement Charge By-law, 1969, No. 912", as amended, shall apply to this By-law with Tespect to the commutation of the annual frontage tax. 7. The Assessor shall forthwith Prepare a Prontage Tax Assessnent Rell in respect of the hereinbefore described parcels in accordance with the provisions of the "Municipal Act" and the “Local Inprovenent Charge By-law, 1969, No. 912", as amended, which said Assessment Roll shall, from rime te tine, be revised by the Assessor in accordance with the provisions of the Muntcipal Ace. 8. This By-law may be cited for all purposes as the "Fraser Avenue Store Sever Local Iroroverent Assessment By-law, 1977, No. 1509",
