Council voted Feb. 12 to place a notice of title on the property at the in- tersection of Eby and Hwy 16 to make sale of the property more difficult. it also authorized staff to explore further enforce- ment options if the tank isn"t moved soon. City fears centre on what would happen if the tank exploded given its proximity to the ambu- lance station, RCMP and fire hall, as well as the railway. Even if there was just a leak, said fire chief Randy Smith, all emergency ser- vices posts would have to be evacuated, disrupting police, ambulance and fire dispatching, possibly for the whole region. Del’s Propane genezal manager Dieter Gartman says the city is being para- noid, adding fears about propane risks go far be- yond the reality, His company installed the tank last fall to service this region. It had city approval to do so, but that was then ievoked when the city in- texpreted the tank as being a “structure” within the meaning of its zoning bylaw, which then trig- gered minimum setback requirements from the property line. The tank couldn't meet those requirements and the | dispute has escalated into one involving lawyers. Provincial gas safety inspectors have approved the tank, Gartman said, which isn’t being used until the issue is resolved. City councillors have admitted that the setback issue is really a tactic to remove the tank from an unwanted location. Gartman said Del’s lawyers have crafted a new option to get around the setback problem by placing a‘covenant on the property. If the city doesn’t agree to that, he said, it will be clear council has no valid reason to reject the tank. And’ at that point, he said, further legal action may be necessary. “We would have to question their zoning bylaws,” he said. . Gingles honoured as immigrant entrepreneur...
