In this area of the City, the building has to be raised in order to meet the minimum habitable floor elevations for flood-proofing purposes. The fourth floor of the building has been set back on all sides in order to reduce its volumetric impact at street level, As the building design addresses the height issue, the Planning Department can support the request for relaxation. The front yard and exterior side yard has been reduced in accordance with the Downtown Development Permit Area Guidelines. The interior side yard conforms to the bylaw requirement. A relaxation of the rear yard setback (from the required 25 ft. to 13 ft.) is being requested in order to accommodate the building design. As the rear yard is located along the lane, this relaxation can be supported. _ The indoor recreation area is provided on the main floor of the building with direct access to an outdoor recreation area at the rear of the building. A second outdoor recreation area consisting of a seating area and a children's play area will be located in the southeast corner of the site, fronting Hawthorne Avenue. Both types. of recreation areas have been provided in accordance with the Zoning Bylaw requirements. As this: proposal generally conforms to zoning requirements and the guidelines of the Downtown Development Permit Area, it is recommended that this application be approved to proceed subject to the conditions noted above.
