May 1 - 7, 1992: May 8, 1992: June 10, June 15, 1992: 1992: Mr. Fabick approached the Planning Department and was informed, by the Director of Planning, that the City had no zone that could achieve a subdivision of his property into two 33 foot lots. He was further informed that such subdivision would be contrary to current Council policies and that any application to achieve such subdivision would have to be recommended negatively by the Planning Department. Mr. Fabick submitted an application for Rezoning of his property from RS-1l to RS-2. The "proposed use" in his application was two single family dwellings. A note in the application indicates that “only one house to be built at this time". (This note was to by-pass Planning's concern that rezoning would not result in permitting a two lot subdivision). The Planning and Development Committee received and approved a report from Planning Department recommending that the Rezoning Application ngt be approved. The Planning Department based its recommendation on the fact that "these new (33 foot) lots would not conform to the Zoning Bylaw, which requires... a minimum lot width of 40 feet. The area of each lot would also be slightly less than the RS-2 minimum area requirement". The report further indicates that "the Zoning Bylaw provisions would have to be amended in order to permit lots of a smaller size" and clarifies that "Council cannot relax the minimum area of a lot by any other means". The report also notes that the subject property is within an area that is designated "Apartment" in the Official Community Plan; "rezoning to RS—2 would encourage the development of new single family residences which is contrary to the Official Community Plan policies". The report concludes that "because the property cannot be subdivided into two legal lots and the use proposed is contrary to the intended uses specified in the Official Community Plan, it is not appropriate to approve the application". In considering the report mentioned above, the Municipal Council passed the following resolution: "That the report from the Director of Planning... regarding... 1943 Manning Avenue be referred to the Planning and Development Committee to examine concerns typical to neighbourhoods where the majority of lots are 33 feet wide". / TEM | PAGE 168 con't page 3
