4 = The permitted uses for M-3 include "warehousing, indoor storage and distribution of manufactured or processed products." This would mean that the "distribution warehouse" part of the business is a permitted use. M-3 also allows “processing and finishing of manufactured goods." Since aluminium railing is a finished product made from an already-manufactured good (aluminium sheeting), this part of the business also is a permitted use. It is inconceivable to me that in this exact scenario a business licence has been denied. I think the public should be aware that the reason the business licence was denied was because of Section 303 of the Zoning By-law which states "The use of land, including the surface of water, of buildings and of structures shall be in accordance with the permitted uses:land regulations snecified in this By-law and any uses not specifically permitted are prohibited." For some reasonuthis is interpreted by staff to mean that, because the applicant wanted to manufacture aluminium rail- ing rather than finish a manufactured good, his licence was denied. What I'm getting at here goes back to what I originally stated. The City's attempt in 1986 to “streamline and uncomplicate" the Zoning By-law was successful in preparing the intended document. However, since then the administration of the By~law has not kept pace with the original intentions and has resulted in an administra- ticn that does not seem to allow any uses to be permitted in the Mi-3 zone. [ would advise that the City review its process of approving business licences. If I have at all shed some interest in further pursuing this, please do what I did when I was not sure what to do. Get on the telephone and ask some of the other Municipal planners in this Province how they go about administering their ‘streamlined and uncomplicated" by-laws with respect to the issuance of business licences. As well, question the planners who work for the Provincial Government who originally proposed the "streamlining" process. In summary, I would once again advise that my position on this proposed amendment is that I feel that it is unnecessary and would complicate the present zoning by-law. Instead, it is- Suggested that the City re-evaluate the intentions of the existing by-law, check with cther Municipalities with regard to their method of approving business licences and get on with accommodating your industrial tenants, instead of creating more complications.
