the construction in reasonable condition. / In the
event that Westview does not remove the Temporary Force
Line within the said sixty day period, then Genstar may,
at its sole discretion, cause its servants, agents or
contractors to remove the Temporary Force Line at the
sole cost of Westview. Westview agrees that any and all
costs incurred in the construction and removal of the
Temporary Force Line will be the sole responsibility of

westview.

In conjunction with performing Westview's obligations
under clause 8.1, Sandcastles agrees to provide Genstar
with an irrevocable bank guarantee (the “Bank
Guarantee") drawn on a Canadian chartered bank in the
amount of SEVENTY THOUSAND DOLLARS ($70,000.00), ina
form substantially as attached hereto as Schedule “p",
aS security for the satisfactory completion of the
installation and removal (to the extent necessary) of
the Temporary Force Line and the Proposed Gravity Sewer,
the returning of that portion of Genstar's lands which
has been disturbed by such installation or removal to a
reasonable condition which allows Genstar to proceed
with its development of such portion of Genstar's Lands,
the discharge and cancellation of any builders’ liens
which may arise during the course of installation and
removal (to the extent necessary) of the Temporary Force
Line and the Proposed Gravity Sewer by Westview, its
Servants, agents or contractors, and the costs incurred
by Genstar in the event of default by Westview in
removing the Temporary Force Line within the time
stipulated in clause 8.1. Westview also agrees to cause
Genstar and its servants to be added as a named insured
on Sandcastles‘ comprehensive liability insurance policy
in respect of the installation of the Temporary Force
Line and the Proposed Gravity Sewer by Westview, its
Servants, agents, or contractors.

With reference to clause 8.2, Sandcastles agrees that
Genstar shall be at liberty =o draw on the Bank
Guarantee, to the extent reasonaliy necessary, if after
being given 14 days prior written notice by Genstar

Westview fails:

(a) to discharge and cancel any builders' liens filed
against Genstar's lands which may arise as a result
of the installation or removal of the Temporary
Force Line and the Proposed Gravity Sewer by
Westview, its servants, agents or contractors;

(b) to reimburse Genstar for any property damage
incurred by or third party claims made against
Genstar as a result of the installation or removal
of the Temporary Force Line and the Proposed
Gravity Sewer by Westview, its Servants, agents or

contractors;
