23. It is understood and agreed that wherever in this Land Use Contract @ guarantee, indemnity or warranty is required to be made to the Municipality, such guarantee, indemnity or warranty may be given by McDonald's Restaurants of Western Canada Ltd. and, similarly, wherever in this Land Use Contract a payment is required to be made to the Municipality or a Letter of Credit is required ta be deposited with the Municipality, such payment or deposit may be made by McDonald's Restaurants of Western Canada Ltd. 24. The Appendices hereinbefore referred to are hereby incorporated into and made part of this agreement. ‘ 25. This agreement shall have the force-and effect of a restrictive covenant running with the land described in Section 2 hereof and shall tbe registered in the Land Registry Office by the Municipality pursuant to the provisions of Section 702A(4) of the "Municipal Act", but the provisions of this section shall not be construed so as to require or permit the registration of this Land Use Contract as a charge on any . ,.portion of the lane doscribed in Subsection (b) of Section 2 hereof while such portion of lane remains dedicated. 26. Wherever the singular or masculine is used herein, the same shall be construed as meaning the plural, feminine or body corporate or politic where the contract or the parties so require. 27. This Agreement shall enure to the benefit of and be binding upon the parties hereto and their respective heirs, executors, administrators, successors and assigns.
