From the City Clerk, March 21st, 1990 regarding Latecomer Charge Waiver
Agreement - Genstar Phase 12

seconded by Alderman Gates:

At the request of and pursuant to the Agreement with Genstar Development
Company dated the 20th day of March, 1990, BE IT RESOLVED that the works and
services described in the aforesaid Agreement and installed or to be installed
by the said Genstar Development Company in connection with the development of
the lands described as:

Portion of Lot 9, Plan 68514, Portion of Pareel A, Plan 66737, all of D.L.
168, 232, 340, 341, 344, Group One, NWD.,

are hereby conclusively deemed to be for the sole benefit of those lands and
that none of the cost of providing the said works and services shall
constitute “excess or extended services" as defined by Section 990 of the
Municipal Act.

AND THAT the aforesaid Agreement be and the same is hereby approved and
that the Mayor and City Clerk are authorized to sign the same on behalf of the
City and to affix the Corporate seal thereto.

At the request of and pursuant to the Agreement with Liberty Homes
Ltd. dated the 8th day of March, 1990, BE IT RESOLVED that the works and
services described in the aforesaid Agreement and installed or to be installed
by the said Liberty Homes Ltd. in connection with the development of the lands
described as:

Portion of Lot 12, Blk 3, Pl. 2153 & Lot A, Pl. 4986 & Lot 130, P1. 53544,
D.L. 380, Group One, N.W.D.,

are hereby conclusively deemed to be for the sole benefit of those lands and
that none of the cost of providing the said works and services shall
constitute “excess or extended services" as defined by Section 990 of the
Municipal Act.

AND THAT the aforesaid Agreement be and the same is hereby approved and
that the Mayor and City Clerk are authorized to sign the same on behalf of the
City and to affix the Corporate seal thereto.
