That Council Authorize the Mayor and City Clerk to execute the following legal
documents which must be registered in conjunction with the approval of the
subdivision plans for Westview Heights Phases II and III developments:

BACKGROUND AND COMMENTS:

When the Westview Heights Master Development Agreement was executed there were
a number of Statutory rights of way and Restrictive covenants registrered over
the parcels of land as they existed at the time. Those which are affected by
the above recommendations can be briefly described as follows:

This restrictive covenant sets maximum densities and minimum open
space areas over lands zoned for multi family use.

This restrictive covenant establishes a buffer zone along the
northern edge of the property to the south of Eastern Drive.

This restrictive covenant prohibits construction of buildings on
the property. This was registered so that the City had some
authority to prohibit building activity in the event the developer
failed to live up to his obligations under the various development
agreements.
