& By-law to authoxize the City to enter into Land Use Contract No,
WHEREAS the

"City of Port Coquitlam Zoning By-law, 1969, No. 918" as

azended designates certain areas of land within the zonosa set out therein as

"Development Areag";

AN WHEREAS the lands hereinafter described are situate within an

area so designated;

AND WHEREAS the Owner of the aaid lands has made application for a

= Land Use Contract to authorize works, development, and use sone aspects of which

are not in conformity with the relevant City By~laws as the sane apply to the

zoné in which the said lands are altuate;

AND WRE:

REAS the Council has given due xegard to the following con~
sidezationa:

1. (a) The promotion of health, safety, convenience and welfare of the public,

(b) the prevention of the overcrowding of land, and the preservation of

: the amenities particular to any zone,

(c) the securing of adequate light, sir and access,

(a) the value of the land and the nature of its Present and psuspective
use and occupancy.

; : {e) the character of each zone, the character of the buildings already

erected and the peculier suitability of the zone for particular uses.
Cf) the conservation of Property values,

the development of areas to Promote greater efficiency and quatity,

the impact of development on present and future public costs,

(e) the Provision of Necessary public space.

and it is deemed desirable to enter into Land Use Contract No. 5 in the forn

and to the extent hereinafter provided;

NOW THEREFORE the Municipal Council of The Corporation of the City of

Port Coquitian, in open meeting assembled,

The Council of The Corporation of the City of Port Coquitlam is hereby

authorized and empowered to enter into a Land Use Contract with Florence Mylrote,

Frank Yezio Kimmel end Mary Mildred Kimmel, in the fora and to the extent in

“Land Use Contract No. 5" which ie the Schedule hereto annexed and nade part

of this By-law,
2. The eaid Land Use Contract No. 5 shall extend to and shall regulate the
development and use of the lands described as:

“Lot 4, Block 32, District Lot 464, Group 1, Plan 7080, New Westminster
District,
3. Land Use Contract No. 5 shall hava the force and effect of a restrictive

covenant running with the lend described in Section 2 hereof and shall be

registered in the New Yeatminster Land Registry Office by the City.

4. This By-law may be cited for sll Purposes as "Land Use Contract No. 5,

Authorization By-law, 1973, No. 1287",
