SUBJECT: Roof Encroachment on Right~of-Way

RECOMMENDATION:

That the builder on Lot 17, Plan 73394 be permitted to continue
the construction of his building with a proposed roof overhang
into the Sanitary sewer statutory right-of-way, subject to him
antering into a Restrictive Covenant in the form attached;

AND THAT the Mayor and City Clerk be authorized to sign the
Restrictive Covenant on behalf of the City.

Background and Comments:

The attached sketch shows the fot and right-of-way down one
side and the location of the projected roof overhang.
Foundations for the house have been poured but no construction
has taken place pending a decision by Counci!.

the corner of the roof wil] overhang the right-of-way by about
l-“1/2 feet at a height above ground of about 8 feet. This
overhang would not create a Significant problem for us if work
in the right-of-way is required.

The alternative for the builder if Council does not grant the
Encroachment Agreement is to cut off one corner of the roct.
This would result in a less pleasing appearance from the

street.
