Freeman City Clerk SUBJECT: Property Transfer ~ Mary Hill Bypass Right-of-Way... RECOMMENDATION: That Council give consideration to Passage of the resolution. ‘set forth on the page attached to this memorandum. BACKGROUND AND COMMENTS: As most members of Council are aware, the City is involved in a complicated transaction with the Ministry of Transportation and Highways and Tri-line Expressways Ltd. in connection with the formal establishment of the Mary Hill Bypass route just northeast of that route's intersection with Kingsway Avenue. The Ministry of Transportation and Highways obtained property from Tri-line Expressways Ltd. and in return therefor Tri-line was to receive certain property from the City (actually a portion of the former Kingsway Avenue) and the City was to receive $35,000. from the Ministry of Transportation and Highways. . Now, nearly two and. one-half years later we are in a position to ask the Council to complete the City's part in the transaction and this can be done by passage of the resolution that follow this memarandum. Basically, these involve the granting of rights-of-way over the closed Portion of Kingsway Avenue to the City itself and to B.C. Hydro; the sale of the Former portion of Kingsway to Tri-line Expressways Ltd.; approval of the required subdivision plan; and agreement to accept $35,000. from the Ministry of Transportation and Highways as satisfactory compensation. While we were dealing with Tri-~line Expressways Ltd. that firm very kindly consented to transfer two additional small portions of property to the'City in order that the dyke right-of-way could be contained wholly within property owned by the City.
