MEMORANDUM Mayor and Council July 5th, 1978 Alderman P.F. Ranger Re: Ricard Subdivision at Pooley-Taylor In response to a complaint about hot flyash and smoke in this area, I visited the site on Tuesday evening. There were two huge fires burning and the site was a scene of devastation. Pirstly, the land is still zoned RS-2 as the Zoning By-law changing it to RS-1l has not received 4th and Final Reading. The land is, therefore, subject to our Tree Cutting By-law No. 1293 and the clearing was therefore done illegally. . Secondly, the subdivision of the land cannot be finalized or approved by the City Engineer until the rezoning is complete. As a matter of fact, the Subdivision Plan is still under active discussion between the Ricards and our Administrator and Engineer. ; As recently as the Council Meeting of June 5th, 1978, I cautioned the Ricards about doing any clearing until the rezoning was complete and the Subdivision Plan approved. Our Parks Superintendent cannot designate which trees must be saved until the Subdivision is approved. If this procedure is not followed, then our tree cutting regulations are a farce and we are back to the 'bad old days' when indiscriminate tree cutting took place. It would appear that the Ricards have completely disregarded our By-laws and procedures in their haste to clear the land. I would recommend that we enforce our Tree Cutting By-law or abandon it and that no Burning Permits be issued to anyone until Rezoning, Subdivision, and pertinent sections of By-law No. 1293 are in place.
