While our Water Way By-law protects the creek bottoms, the banks are subject to private landscaping and clearing which may remove one of the vital components for fieh survival. ‘The folaga adjacent to erceka protects against bank errosion and sluffing as wall as keaping the water temperacure cool which ia nesessary for eurvival of fish fry, Artificial landscaping and miscellaneous trae Planting by private pere gone cannot replace the natural growth and root structures required for bank etability, It is evident chat if we wish to maintain the existing creeks in spawning condition strict enforcement of our water way by~lawe and a "leave strips" which encompasses approximately 30’ on both sides of the water way are necessary. There are three possible ways of protection: (1) The leave strips can be accommodated via section 24A of the Land Registry Act, which allowa the City to have reglatered, at the time of subdivision a covenant with epecified conditiona, That at the time of subdivision a dedication to park in order to protect the water way can be required. The desired area can be conveyed as a lot to the City as a condition of the subdivision. ' After considering the options I would recommend that the restrictive covenant as outlined under item (1) be used. The covenant achieves the desired affect without taking maintenance and ownership. In some instances an ownew may ba reluctant to give up the land which in turn could ba envolve a City expenditure, As owners of the land we would share in the responsibility of continued maintenance particularly if it waa dedicated park,
