Deputy City Engineer SUBJECT: DCC AGREEMENT - SUBDIVISION OF 3610 WESTWOOD STREET RECOMMENDATION: That Council authorize his Worship the Mayor and the City Clerk to authorize the attached agreement made with the developers of the proposed subdivision of 35 10 Westwood Street. BACKGROUND & COMMENTS: The lands at 3610 Westwood Street are owned by CP Rail and they are proposing to subdivide the land and sell a portion of it to Millbrook Investments Ltd. Currently, only Roads DCC would be applicable to the proposed subdivision however, we are finalizing a proposed Drainage DCC for the area. We do not anticipate approaching Council with a recommended DCC until sometime in January 1992 and in order for this subdivision to proceed now the developer has agreed to secure a $25,000 Letter of Credit and an agreement with the City which would obligate them to conform to the new DCC Bylaw after its implementation. The agreement was drafted by the City Solicitor Mr. Grant Anderson and while it is a relatively new concept we feel it does protect the City. Of special note is clause No. 8 which indicates that the developer, Millbrook Investments Ltd., will remain liable for the future Drainage DCC’s even if the land title is transferred to others. It may also be interesting to note that we have entered discussions with some potential developers of the Riverwood lands using the same concept as this whereby they would secure Letters of Credit against future DCC Bylaws and sign agreements binding them to the future bylaw.
