snes Division 3 - Permits An application for a Development Permit or an amendment to a Development Permit shall be made to ‘the Director of Community Planning: on the Application Form attached as Schedule "C" of this Bylaw. An application for a Deve lopment Variance Permit or an amendment to a Development Variance Permit shall be made to the Director of Community Planning on the Application Form attached as Schedule "D" of this Bylaw. (a) A Development Permit shall be in the form of permit attached as Schedule "E" to this Bylaw. (b) A Development Variance Permit shall be in the form of permit attached as Schedule "P" to this Bylaw. Where an application has been made in conformance with Section 7 or Section 8 of this bylaw and the required fees have been paid: (a) the Director of Community Planning shall have a report prepared advising Council of the merits of the application; (b) the City Clerk shall have the report from the Director of Community Planning placed on an agenda of a meeting of the Council; and, the Council shall: (4) refuse the application; or, (ii) approve the preparation and issuance of a Development Permit subject to requirements and conditions as per Section 976 and 980 of the Municipal’Act; or, (iii) imstruct the Clerk to give the notice pertaining to a oe Development Variance Permit required by Sections 980 (13) and. 980 (14) of the Municipal Act; such notice shall be given in respect to all parcels within 40 meters (131.2 feet) from that. part of the land that is subject to the permit. so 11. Where an application is refused by Council, no subsequent application for the same Permit may be submitted for a period of six months, subject to Section 954(3) of the Municipal Act. | . “s 12. (a) Every Development Variance Permit or Development Permit which has not- been issued within 12 months from the date the preparation of the Permit was authorized by Council shall not be issued unless Council extends the time for issuance for a period of up to one year and an additional non-refundable fee of $400.00 is paid. | (b) More than one extension may be given under this section.
