PLICATION OF BYLAW It shall be unlawful for any person to cut or allow to be cut, trees on any property in a Developme.it Permit Area without having obtained a Tiee Cutting Permit. Applications for a tree cutting permit shall be made to the Director of Parks and Recreation by completing the forms attached hereto as Schedules A and B and forming part of this Bylaw and a permit may be issued by the Director of Parks and Recreation if the application complies with this Bylaw. Applicaticns shall be accompanied by: (i) (4i) (iii) (iv) (v) (vi) a letter explaining the reasons for the proposed tree cutting; letter of authorization where the applicant does not own the subject land; a tree survey; a tree cutting and replacement plan where required by the City; a report from a qualified person, where required by the City; a report from a Geotechnical Engineer confirming to the City’s satisfaction that the proposed tree cutting and replacement plan shall not in any way create a danger to the lands or adjacent lands from flooding, erosion, land slip or potential tree falls, where required by the City; proof of approval of the Ministry of the Environment in the case of any areas protected for fish habitat or floodproofing purposes; proof of liability insurance carried by the tree removal company retained; and a non-refundable permit application fee of $50.00, plus $20.00 for every tree proposed to be cut or removed. PERMIT CONDITIONS Tree cutting and replacement shall be strictly in accordance with the conditions imposed by this Bylaw and any special conditions specified in the Permit, including: (a) municipal staff may enter a tree cutting/replanting site at any reasonable time for inspection and to administer and enforce the Bylaw; the Director of Parks and Recreation may suspend or revoke a permit at any time if it is determined that tree cutting and replacement is not being undertaken according to the conditions of the Bylaw and permit; protective barriers shall be installed and approved prior to tree cutting; and 2836 2 | ITER | {2
