WHEREAS the Owner is the registered owner of the Lands
herein defined and has requested the City. to grant. to her
permission to make the Encroachment herein defined;

AND WHEREAS the City agrees to grant the Owner's
request subject to the provisions of the City's bylaws as amended
from time to time and subject to the terms and conditions of this
Agreement;

NOW THEREFORE THIS AGREEMENT WITNESSES THAT in
consideration of the premises, the covenants. herein contained,
and. other good and valuable consideration THE PARTIES i.uwReEBY
AGREE AS FOLLOWS:

1. The Owner is the registered owner of those certain
jands situate in Port Coquitlam, British Columbia which are more
particularly described as:

(the "Lands").

2. The City grants to the owner permission to use that
portion of a highway in the City »ich is shown outlined in red
on that certain sketch attached as S.‘hedule "A" hereto, and which
is further described as:

(the "Encroachment")
