RECOMMENDATION :

THAT City Council direct the Clerk's Office to inform surrounding property
owners of this application and to place the following resuolution on a
subsequent agenda of City Council

And That City Council adopt a resolution to grant a Development Variance
Permit to Lot 5 of D.L. 233 NWLD Plan 79828 for relaxation of the-rear
yardsetback requirements of the Zoning Bylaw No. 2240 Section 802, RS-2
Small Lot Residential, Subsection (6) Rear Yard to permit an encroachment

of a deck.

COMMENTS :

This application is being submitted by the home owner after discovering
that their deck encroaches into the rear yard setback. The deck was
constructed encroaching by the builder. The owner was not aware of this

problem untill they had an inspection.
approval of the encroachment is recommended as it does not affect any city

policy.
