Brown Director of Planning 1812 Jacana Ave. Development Variance Permit File No. 42/89 RECOMMENDATION : THAT City Council direct the Clerk's Office to inform surrounding property owners of this application and to place the following resuolution on a subsequent agenda of City Council And That City Council adopt a resolution to grant a Development Variance Permit to Lot 5 of D.L. 233 NWLD Plan 79828 for relaxation of the-rear yardsetback requirements of the Zoning Bylaw No. 2240 Section 802, RS-2 Small Lot Residential, Subsection (6) Rear Yard to permit an encroachment of a deck. COMMENTS : This application is being submitted by the home owner after discovering that their deck encroaches into the rear yard setback. The deck was constructed encroaching by the builder.
