The proposed amendments to the Vancouver Charter are presented below:

I. Section 180 is amended as follows:

"The Council shall protect, defend and indemnify an officer or employee of the
Municipality or a Member of its Council, where..."

by adding to subsection (2):

arising under the Waste Management £ t, the Canadian
Invironmental Protection Act, the Fisheries Act and other similar environmental
legislation where the officer, employee, or Member of Council, has not acted
willfully corstrary to the terms of his ernployment or has acted on the instructions of a
superior."

by replacing subsection (6) with the following:

"(6) The Council shall not seek indemnity against an officer, employee, or Member

of Council, in respect of any action of the officer, employee, or Member, that

results in a claim for damages against the Municipality, but the Council may

seek indemnity against an officer, employee or member or where,. in relation to

the action that gave rise to the claim against the officey, or employee, the
officer or employee willfully acted contrary to: :

(a) the terms of his employment, or

.

(b) an order of a superior

Il. Section 294 is amended by replacing subsection (5) with the following:

"3) Subsection (3) does not provide a defence where

the municipal public officer has, in relation to the conduct that is the .
subject matter of the action, been guilty of dishonesty or malicious or .

willful misconduct, or :

the cause of action is libel or slander.”
