Re: Re~Zoning Application R#15-74 - Land Use Contract #13 - Westgate Enterprises Ltd.

In order to implement the recommendations of the City Engineer's memorandum of
November 7th, 1975, respecting the above-noted matter it will be necessary for the
following resolutions to be passed:

1. -"That the third reading of By-law 1388 as given on the eighth day of
September, 1975 be rescinded".

‘2. "That Land Use Contract No. 12, being the schedule next to the "Land
Use Contract No. 13 Authorization By~law, 1975, No. 1388", be amended in
the following manner:

A. That Clause (b) of Section 13 be struck out and the following substituted:

"(b) As security for the due and proper performance of all the covenants
and agreements in this contract contained, the developer covenants
and agrees to deposit with the Municipality by Letter of Credit the
suni of $19,000.00 drawn on the Bank of British Columbia".

Section 14 be struck out and the following be substituted therefore:

The developer further covenants and agrees te contribute forthwith
to the Municipality the sum of $36,960.00 being the net total of
these amounts set out in Section "B" of Appendix II hereto, required
to defray the excessive cost incurred by the Municipality for the
purposes set out herein and which the Municipality covenants and
agrees to apply to the cost of those works and services. set out in
the said Section "B" of Appendix II hereto”,

That Appendix II be struck out and the following substituted therefore:

" APPENDIX II

Section A —- Works to be constructed by Westgate Enterprises
Ltd. as provided in Section 11 of Land Use
Contract No. 13:
