November 18th, 1974 for Handley Crescent. Mrs. L.M. Clark, 3347 Handley Crescent, stated she would like a guarantee that the assessment will go down if the improvements proceed; however, Mayor Campbell advised this cannot be done. Moved by Alderman Laking: Seconded by Alderman Traboulay: That after the proposed works of Local Improvement have been completed on Handley Crescent, the Assessment Court of Revision be requested to take into consideration the inequities that have occurred on corner lots and make appropriate adjustments to assign frontages that are more in keeping with the average size lots on the street before the charges are placed on the tax roll. Carried. From the City Clerk, October 31st, 1974, referring to the proposed City Clerk re proposed closure-N. portion - McKenzie Ave. closure of the small section of McKenzie Avenue that extends West off Pitt River Road in the 1400 block, mentioning that the South half was closed and sold to Mr. John Kerr, who subsequently consolidated it with adjacent property owned by him, and who since sold the land to John William Scott and Carole Susanna Scott, and advising that no reply has been received to letters written ty the new owners in seeking to obtain their consent to close the Northerly portion of McKenzie Avenue. The City Clerk, in his report, stated that in normal circumstancas there would be little that could be done as the consent of the adjacent owner is a prerequisite to the Crown relinquishing its title to a closed road; however, in certain very limited circumstances this rule can be waived and the Council may well consider that the persons who receive the ultimate benefit of the closure of one half of the road (the Scotts) should not be able to hold up the closure of the other half simply by withholding their consent. Mrs. Scott was in attendance at the meeting and on invitation of Mayor Campbell, spoke to the meeting and inquired what would happen to the section of McKenzie Avenue in question once closure has been effected, and Alderman Laking advised it would be offered for sale. Moved by Alderman Laking: Seconded by Alderman Ranger: That with respect to the "Second McKenzie Avenue Road Closure By- law, 1974, No. 1323" and the Petition to the Lieutenant-Governor in Council thereon dated July 9th, 1974 authorized by resolution of the Council on July 8th, 1974, the Lieutenant-Governor in Council be advised
