harmless B.C. Hydro against and from all loss, costs, damages, actions, claims and demands whatsoever arising directly or indirectly out of or connected with the encroachment and, in . particular, but without restricting the generality of the foregoing, will indemnify B.C. Hydro against and from any claim made by any person whomsoever in respect of or arising out of the encroachment. The Corporation shall assume and indemnify B.C. Hydro from any third party liabilities that may arise due to service interruptions resulting directly or indirectly from the Corporation's activity within or adjacent to the right of way. The Corporation shall also pay B.C. Hydro for any and all losses B.C. Hydro incurs which are directly or indirectly attributed to the Corporation's activity. The Corporation shall be responsible for any damage to B.C. Hydro's works including roads which occurs as a result of the Corporation's canstruction, operation, use and maintenance of the encroachment within the right of way. B.C. Hydro's consent applies to Hydro's rights only. The | Corporation shall obtain all necessary cansents from all other parties with any interest in any affected property and shall comply with any applicable legislation and/or regulations. The terms and conditions in this consent are to be read in conjunction with the Statutory Right of Way Agreement charged on the land and shall not be construed as diminishing the terms of the right of way agreement. The Corporation shall adhere to all WCB rules and regulations pertaining to this type of work, specifically Section 24 of the Industrial Health and Safety Regulations. Crews nust be aware they aré working in the vicinity of a 60,000 volt transmission line. Men and equipment-must not. encroach within-3.0 metres. of the — transmission line conductor. Upon the execution and receipt of this Letter Agreement by the undersigned and a minimum of 72 hours prior to commencement of work within the right of way, the Corporation shal! contact H. Morgan, (Lower Mainland Transmission) at 469-8853, to arrange for an on- site meeting with the contractor. This on-site meeting is necessary to: _ ; a) discuss safe working procedures while in the vicinity cr — energized high voitage transmission lines and the completion of WCB Forin 30M33, if required for equipment activity. b) establish adequate ground to conductor clearances for our distribution underbuild at the west end of the site.
