Dear Mr. Day:

Given the circumstances I believe it is reasonable for the Strata Council to absoive the municipality
from damage to Common property.

The waiver does not protect the City for damage to. a lot owner's property, or injury to persons.

The most likely dasnage I would assume in these narrow confines is damage to fences, gardens and
ornamental or other works of the Strata Corporation. | 7

I believe the waiver will be effective as the Strata Council enters into the agreement with
knowledge that property damage could result, and they knowingly accept that risk in the contract.

The proposal seems a fair one given the service extension to private property.
