REQUIRED RELAXATIOGNS: The steep slopes of the site and the presence of a restricted convenant to protect the slope, along the west side of the property, imposed some unusual constraints on this property. The applicants responded by significantly reducing the density of the site and creatively placing the vnits to deal with the site characteristics in the appropriate way. In doing so, the "front yard set-back," along Fort Fraser Rise is proposed to be reduced from 7.5 meters to 4.5 meters. Giving the fact that the land slopes down from Fort Fraser Rise, approval of this relaxation should not result in a negative impact on the street scape. The Development Variance Permit will also relax the size and location of outdoor recreation space to permit the construction of the view balconies on the west side of the property, instead. DISCUSSION The applicants are attempting to develop a low density, high quality project on a very difficult site. With creative design they managed to accommodate the project in compliance with most bylaw provisions, however relaxation of the front yard was unavoidable. In consideration of the unusual characteristics of the site, and the quality of design, the Planning Department recommends that this Development Variance Fermit be approved.
