This was done to ensure that the City had some control to ensure that the requirements of the building scheme were adhered to and not cancelled by the developer. AB210320 This is a right of way registered to accommodate a proposed retaining wall adjacent to Eastern Drive. AB210322 This is a right of way along the northern edge of the property between Eastern Drive and Mary Hill Road to facilitate the future construction of a trail for public passage. AB210326 This is a right of way accommodating a sanitary sewer main across a portion of the Phase III site. | AB210316 This section 215 restrictive covenant was registered as a backup to the developer's section 216 building schene covenant for single family areas. This was registered for the same reasons as noted above for the multi family building scheme. The covenant extensions and partial discharges noted in the recommendations are housekeeping measures which are necessary to ensure that the existing tights of way and covenants apply to areas which were previously road allowance and which will be incorporated into the new lots ยป that building schemes for multi family and single family development apply to properties zoned for those uses respectively, and that rights of way encumber only those new lots which the right of way actually crosses. | There is one new covenant which will ensure that the one access to Mary Hill Road from the Phase III townhouse site will be used for emergency access only and that the owners will install and maintain structures to prevent public access.
