2. The Covenantor shall not at any time construct, Or permit the construction, on the Land of a building or buildings which contain more than twenty-four dwelling units. 3. The Covenantor shall not permit the use of any building or development on the Land for the occupancy of more than twenty-four dwelling units. 4. Nothing contained or implied herein shall prejudice or affect the City's rights and powers in the exercise of its legislative or regulatory functions, and all statutes, regulations, bylaws and orders may be exercised in relation to the Lands as if this Covenant had not been granted, 5. This Covenant runs with the Land. 6. The Covenantor hereby releases, indemnifies and Saves the City harmless from and against all claims and demands whatsoever by any person, arising out of or in any way due to the ‘granting or existence of this Covenant. 7. The Covenantor hereby authorizes the City in its discretion todo all things necessary to obtain priority for this Covenant over all charges and encumbrances registered against title to the Land. 8. This Covenant enures to the benefit of and is binding on the parties and their heirs, executors, administrators, successors and assigns; every reference in this Covenant to each party includes the officers, employees, agents and contractors of each party; whenever the singular or masculine is used in this Covenant, the Same is deemed to invslude the plural or the feminine or the body corporate as the context so requires; waiver of any default by either part shall not be deemed to be a waiver of any subsequent default; and this Covenant is i j i i AN By reese
