Deputy City Engineer REQUIRED AGREEMENTS - PROPOSE SUBDIVISION - 1202 CEDAR DRIVE RAFIKT ESTATES LTD. AND RALLE ESTATES LTD. - FILE S# 21/92 (Pablic Works Comunittee - December 2, 1992) That Council approve the following documents and authorize the Mayor and City Clerk to execute the agreements on behalf of the City.: a) Section 215 Restrictive Covenant whereby the covenantor agrees that it shall not build, place, erect or permit the building of any structure on the land and shall not make application for a building permit and no building permit shall be issued until all on-site and off-site services necessary for the development of the lands have beers completed to the satisfaction of the City. Modified City Developer’s Agreement (five year term). Standard City Latecomer Charge Waiver Agreements; and Section 215 - Flood Covenant Agreement (Standard form - Ministry of Environment) As part of the proposed subdivision of 1202 Cedar Drive the following agreements are required as part of the approval; Section 215 Restrictive Covenant (No building until all on-site and off-site services are completed), modified City Developer's Agreement, Standard Latecomers Charge Waiver agreement and Section 215 Flood Covenant (Ministry of Environment). The Developer applied for and received approval for a Development Variance Permit (October 19, 1992) which provides relaxation to permit approval of the Subdivision without connecting to off site services for a period of up to five years. The City’s Standard Developers Agreement has been amended to provide that the services are to be installed prior to the completion of a five year term (normally one year term) and that the letter of credit amount be increased based on a 5% inflation rate over the five year term. This has been reviewed with the City’s Treasurer and is acceptable to him, These agreements have been reviewed by the City’s Solicitor and have been found acceptable. Accordingly, it is recommended that these agreements be approved by Council and execution by the Mayor and City Clerk on behalf of the City. JEY:ck
