Eng-, City Engineer SUBJECT: Train Whistling Legislation - a Works and Services Committee, February 28th, 1984 RECOMMENDATION: . That the City do not pass an anti-train whistling bylaw. BACKGROUND AND COMMENTS: . The District of Coquitlam has recently taken steps to adopt a bylaw prohtbiting the whistling of trains af certain. crossings within the District. One of these crossings, on Westwood Street, is shared with the City and another crossing on Kingsway Is entirely within the City but the whistiing occurs in the District. The proposed Coquitiam legislation is obviously Ineffective unless the City also passes a simitar bylaw. Attached you will find a copy of the request from the District. Background information on the legal aspects based on a City proposal several years ago has also been distributed with the Minutes of the Works and Services Committee. The Committee is concerned that the legal position of the City In the event of an accident at a rallway crossing. has never been resolved. The Committee also feels that drivers approaching should be given all the protection possible and the sounding of train whistles Is part of this protection.
