This subdivision has been in process | : Since 1980 and involves a complex exchange of properties and . road allowances between the City and the owner. It Ts desirable to have this subdivision proceed in order to straighten out encroachments by both the City and the property owner on each ofherts property. The cost of subdivision ts excessive because of the high . cost of bridges needed to provide access across Cedar ditch to the individual lots. The developer has approached the City requesting that the most northerly lot be allowed to have access from the dyke access road. This would allow direct access onto that lot without the requirement of a bridge. The dyke access road is gravel and approximately the width of a standard lane. Lane access is allowed in other areas of the City and would be no different here if this were a True lane. Because it is not a true lane, but actually crosses City . owned land, {ft fs necessary to get Council! permission for this access. This access could be legalized by either dedicating a portion of the City tot as road allowance or by a restrictive : covenant upon the lot which would control the use of the access. A restrictive convenant would ensure that the property Owner has right of access in perpetuity and that he not be allowed to block the use of the dyke by the City or the public. |
