DISCUSSION: The project generally conforms to the Zoning Bylaw and the design guidelines for Development Permit Area III. A relaxation (from 25 feet to 12 feet) is required for a portion of the exterior side yard (along Fox Street) in order to accommodate the design. The interior sideyard adjacent to the existing mixed-use building, however, exceeds the bylaw requirement by 5 feet. Indoor and outdoor recreation areas are provided in accordance with bylaw requirements. Portions of the third floor of the building have been recessed in order to reduce the volumetric impact of the building. As the proposed building generally conforms to bylaw requirements and design guidelines for the area, it is recommended that this application be approved subject to the conditions noted above.
