Eng., City Engineer Discharge of No Building Covenant - Lot 66 Westview Heights Development (Public Works Committee Meeting October 17, 1989) Recommendation: That the Mayor and City Clerk be authorized to execute the attached form of Discharge of a Covenant which is currently registered against Lot 66, Plan 79396. Background and Comments: At the time of approving the Westview Heights Subdivision, the City imposed a "No Building" Restrictive Covenant over all of the lots created. The purpose of this Covenant is to provide additional protection for the City in the event that the developer fails to fully comply with the City's requirement. The intention was to arrange for a blanket discharge of this Covenant over all of the lots once all of the City's requirements are met. AS Council members know, we have not reached this point yet. In the mean time, the present owner of Lot 66 (Ms. Mara) in Phase 1 of the subdivision wishes to have this Covenant discharged so that the sale of her property can proceed. The Public Works Committee has reviewed this specific request and sees no reason why this request can not be discharged at this time. The only problem may be that the granting of this request will result in other similar requests. From an administrative standpoint the worst scenario is the separate discharge of this covenant for each of the lll lots in this phase of the development. However, this is unlikely to happen in that we are getting very close to the point where a blanket discharge for every lot in this subdivision is possible. .M. Chong, P.
