REPORT UJ } —— ‘ MAR 20 197 4 8 TO: Mayor and Council March 16th, 1978 FROM: Community Development Committee The Community Development Committee met on Wednesday, March 15th, 1978 and discussed the following items: : 1. Request for Water Lease -— Benneck's Marina This matter was referred back to the Committee from a previous meeting of Council to investigate a number of areas. The Committee had recommended that the Harbours Commission be granted permission to approve a Water Lease lying adjacent to the City's road allowance at a site previously occupied by the old Federal Government whart. The question was referred back to the Committee for further investigation of leasing, in particular, whether or not the City could lease the area and then sub-lease to Benneck in order to maintain control. The Committee discussed further information on leases prepared by the Administrator. (see memo attached). The principal points are that the Harbour Commission will not normally approach the City when leases along the River come up for renewal, except where the City is the upland owner. The Harbour Commission normally restrict their leases for up to five years where the applicant is not the upland owner, however, where an upland owner applies for a Water Lease for some integrated use, leases can be up to 20 years. It is also clear that the Harbour Commission will not permit the City to lease and then sub-lease to Benneck. The Committee also reviewed the City's other accesses to the River and found that we have a number of other locations where access can be gained, therefore this road allowance is not our only access, The Committee also discussed the conditions of approval that were recommended to Council. These were: i. That the lease be for a five year period only. ii. That the access to adjacent property owners not be cut off and that public access to the River be allcwed. The Committee also discussed a further restriction that would prevent mooring of ‘floating homes' at this location. Both the applicant and the Harbours Commission agree that the restrictions suggested by the Committee can be incorporated in the lease, Another point made by the applicant was that the leases are all subject to cancellation within 30 days, therefore none of the leases granted have a definite long-term implication. The Committee recommends that we grant approval for the leasing of the foreshore adjacent to public road allowance at the old Government Wharf site on the Pitt River, subject to: i. That the lease be for a maximum of a five year period. di. That public access be maintained to adjacent owners of property. dii. That public access to the River be maintained. iv. That the mooring of floating homes or live-aboards be prohibited,
