City Engineer ENCROACHMENT OF ROOF OVERHANG OVER STORM/SANITARY SEWER. RIGHT OF WAY - 1273 COUTTS PLACS (Poblic Works Committee Meeting of June 16, 1992) That Council approve a request to allow a minor encroachment of a roof overhang on to the sanitary/storm sewer right of way over the southern portion of the lot at 1273 Coutts Place provided that the owner agrees to register a restrictive covenant at his expense stating that the property owner would assume any responsibility for damage to the encroaching roof overhang that may occur during maintenance work for the sanitary/storm sewer in the right of way. Attached is a report dated May 29, 1992 from the Project Technician regarding a letter from Mrs. Elaine McFagan of 1273 Coutts Place requesting approval for the encroachment of a roof overhang. As shown on the attached plan 1, the roof of the house at 1273 Coutts Place is encroaching a distance of approximately 1 metre over the 3 metre wide road right of way. Also, the encroachment is approximately 10 feet above ground level. Although it is Council’s policy to not allow any encroachments onto easements, the house is already built and has been occupied for over two years and the owner is willing to accept responsibility for any damage in the event that may result from work on the sewer lines in the easement. Therefore it is recommended that this encroachment be approved provided that the owner registers a restrictive covenant assuming responsibility for any damage to his property as a result of sewer line maintenance.
