THE CORPORATION OF THE CLTY OF PORT COQUITLAM BY-LAW NO. 138 A By-law to authorize the City to enter into Land Use Contract No. 13 WHE'EAS the "City of Port Coquitlam Zoning By-law, 1969, No. 918" as azenied des{gnates certain areas of Land within the zones set out therein as "Development Areas" AND WHEKEAS the lands hereinafter described are situate within an area so designated; m2 WHEREAS the Owner of the said lands has made application for a Land Use Contract to authorize works, development, and use some aspects of which are not in conformity with the relevaat City By-laws as the same apply to the zone in which the said lands are situate; AND WEEREAS the Council has given due regard to the following considerations: 1. (2) the promotion of health, safety, convenience and welfare of the public. (b) the prevenrion of the overcrowding of land, and the preservation oi the amenities particular to any zone. (c) the securing of edequate light, air and access. (4) the value of the land and the nature of its present and prospective use and occupancy. (e} the character of each zone, the character of the buildings slready erected and the peculiar suitability of the zone for particular use. (£) conservation of property values. 2. {a) development of areas to promote greater efficiency and quality. (b) impact of development on present and future public costs. (c)} betterzent of the environment. (d) fulfillment of community goals. (e) provision of necessary public space. and it is deexed desirable to enter into Land Use Contract No. 13 in the forn and to rhe extent hereinafter provided; NOd THEREFORE the Municipal Council of The Corporation of the City of Port Coquitlam, in open meeting assembled, enacts as follows: 1. The Council of The Corporation of the City of Port Coquitlam is hereby authorized and capowered to enter into a Land Use Contract with Westgate Enterprises Ltd., 760 ~ 890 West Pender Street, Vancouver, B.C. in the form and to the extent set forth in "Land Use Contract No. 13 which is the Schedule hereto annexed and made part of this By-law. 2. ° The said Land Use Contract No. 13 shall extend to and shall regulate the development and use of the lands described as: Lot 399, South-west Quarter Section 6, Township 40, Plan 44809, New Westninster District. 3. Land Use Contract No. 13 shall have the force and effect of a restrictive covenant running with the land described in Section 2 hereof and shall be regiscered in the New Westminster Land Registry Office by the City. 4. This By-law may be cited for all purposes as "Land Use Contract No. 13 Authorization By-law, 1975, No. 1388". Read a first time by the Municipal Council this Thirtierh day of June, 1975.
